1. What you are reading

A daily aggregation of tungsten and cobalt price assessments that other publishers make publicly available. We record the numbers, restate them on a common unit basis, and publish a consensus. We are not the originator of any assessment, we are not a party to any trade, and we do not act as a broker, dealer, agent or adviser.

2. No contract, no settlement, no benchmark

No figure published here may be used as the reference price, settlement basis, indexation basis or valuation basis of any sales contract, supply agreement, procurement contract, financial instrument or derivative. These are indicative references only. They are not a benchmark within the meaning of the EU Benchmarks Regulation, are not administered as one, and must not be used as one. If you need a contractual reference price, agree it bilaterally with your counterparty or license an assessment from its publisher.

3. Accuracy and availability

Published on a best-efforts basis, “as is”, with no warranty of any kind, express or implied, including accuracy, completeness, timeliness, or fitness for a particular purpose. The numbers are derived from sources we do not control; those sources may correct, restate or withdraw an assessment at any time, and their publication schedule is theirs, not ours. The service may be interrupted, changed or discontinued without notice.

4. Limitation of liability

To the fullest extent permitted by law, Yatech Materials accepts no liability for any loss or damage — direct, indirect, incidental, consequential or otherwise, including lost profits or lost trading opportunities — arising from the use of, or reliance on, anything published here or from the unavailability of the service. Where liability cannot be excluded, it is limited to the amount you paid to access the service, which for a free service is zero.

5. Third-party assessments and intellectual property

Source assessments, their selection and their presentation remain the property of their respective publishers. We publish derived figures, attribute every one of them, and link to the source so it can be verified. Names and marks belong to their owners and are used only to identify the source of a figure. If you are a rights holder and want a figure removed or a citation changed, write to [email protected] and we will action it promptly.

Our own commentary, page design and aggregation method are ours. You may quote individual figures with attribution and a link back to the dated page. You may not systematically scrape, republish or redistribute the dataset, or present it as your own.

6. Fair use of the service

Do not attempt to overload, probe or circumvent the service, and do not resell it as a data feed without written agreement. Reasonable automated access — a news reader polling the RSS feed, a crawler respecting robots.txt — is welcome.

7. Personal data

The only personal data we hold is the email address you give us if you subscribe to the digest, and we use it for nothing else. See the privacy policy.

8. Changes and governing law

These terms may be revised; the version published at this address is the current one, and the session date below tells you when this copy was generated. They are governed by the laws of the Peoples Republic of China, and the courts of Xiamen, Fujian have non-exclusive jurisdiction. If any provision is held unenforceable, the rest stands.
